Terms & Conditions for Beyond Noire – Travel & Photoshoot Experiences

1. Scope

These Terms and Conditions apply to all contracts between the client (hereinafter referred to as the “Participant”) and Lucie Michaelis, operator of Beyond Noire, regarding the booking and participation in trips, photoshoots, and related services.

2. Services

Beyond Noire offers exclusive photo travel experiences, which may include the following:

• Accommodation in a selected villa or apartment

• Local transfers (including airport transfers)

• Catering (as specified in the individual offer)

• Organized activities and excursions

• Professional photoshoots (boudoir, swimwear, portrait, etc.)

• Make-up & hairstyling by professional artists

• Personal on-site support

The exact scope of services is defined in the respective offer and booking confirmation.
Flight tickets are not included in the price and must be booked by the Participant. Assistance with flight research is available upon request.

3. Booking & Contract Formation

Bookings are made in writing or via an online booking system.
A binding contract is concluded upon receipt of the booking confirmation from Beyond Noire.

 

4. Deposit & Payment

After receiving the booking confirmation, a non-refundable deposit of 30% of the total amount is due within 7 days.
This deposit is non-refundable, regardless of the reason for cancellation by the Participant.
The remaining balance must be paid no later than 45 days before the start of the trip.
For last-minute bookings (within 45 days before departure), the full amount is due immediately.

 

5. Cancellation by the Participant

The Participant may cancel the trip at any time before the start. Cancellations must be made in writing.
The following cancellation fees apply:

• Up to 45 days before departure: 20% (deposit)

• 45 to 30 days before departure: 35% of the total price

• From 29 days before departure: 50% of the total price

Rebooking or transferring the booking to another person may be possible upon prior consultation.

 

6. Cancellation by Beyond Noire

Beyond Noire reserves the right to cancel the trip for good cause (e.g. insufficient number of participants, force majeure, illness of the photographer).
In such cases, all payments made will be fully refunded.
No further claims (e.g. for already booked flights) will be accepted.
Beyond Noire will confirm the trip in writing before the Participant books their flight. This ensures that no cancellation costs arise from non-refundable flights.

 

7. Photos & Usage Rights

The Participant will receive a selection of professionally edited images for private use only.
Commercial use by the Participant is only permitted with prior written consent and subject to additional fees.
Beyond Noire may – with prior approval – use selected images for promotional purposes (website, social media, etc.).
This consent may be revoked at any time.

 

8. Liability

Participation in the trip and all activities is at the Participant’s own risk.
Beyond Noire accepts no liability for health issues, accidents, theft, or loss during the trip.
Participants are strongly advised to obtain travel insurance, including cancellation and international health coverage.

 

9. Health & Responsibility

The Participant confirms that she is physically and mentally fit to take part in the trip.
Allergies, intolerances, or special needs must be communicated in advance.

 

10. Data Protection

Personal data will be processed solely for booking and client support purposes.
Our privacy policy applies (see data protection statement).

 

11. Final Provisions

German law applies.
Place of jurisdiction is Stuttgart, if legally permissible.
If any provision of these Terms and Conditions is found to be invalid, the validity of the remaining provisions shall remain unaffected.
